The underlying question of when a legal duty to consult arises in the development of a project has remained a key uncertainty that has very significant policy implications.
Kevin O'Callaghan’s practice is focused on Aboriginal and corporate social responsibility law. Providing strategic advice on Aboriginal, regulatory, environmental and other corporate social responsibility issues, Kevin has assisted clients around the world and throughout western and northern Canada.
If unavoidable conflicts arise during project development, Kevin appears before courts, tribunals and arbitration panels to assist resource companies on challenges to licenses by local communities, non-governmental organizations and indigenous communities. Kevin has acted as counsel for a coalition of business on critical Aboriginal cases at the Supreme Court of Canada, dealing with issues of consultation, accommodation, and Aboriginal rights and title.
Kevin practice also involves complex commercial litigation, advising predominantly on environmental matters. His Aboriginal law expertise is recognized in Chambers Canada.
