Nicolas Faucher is the co-leader of the Fasken’s Financial Institutions Group and the co-president of the Corporate/Commercial section.
He practises commercial law, mainly in the areas of financial institutions, financial services and technology. He has also developed a particular expertise in all aspects of regulatory compliance in these areas. Before joining Fasken, Mr. Faucher first worked as a legal advisor at the two largest financial institutions based in Québec, and from 2001 onwards was a member of a major business law firm in Montréal.
Over the course of his career, Mr. Faucher has advised Canadian banks, credit unions and savings banks, insurance companies, non-banking entities and other participants in the financial services sector on the implementation of legislation in their businesses, on matters of regulatory compliance and in the negotiation of commercial agreements to their benefit. These agreements include those related to mergers and acquisitions, strategic alliances and commercial partnerships, investments, technology and outsourcing business functions. His clients also notably include Fintechs and Insurtechs as he is heavily involved in these fields.
Mr. Faucher has also developed a special expertise in the payments as in the operations management of credit and debit card issuers and acquirers, processors, gift/prepaid/stored-value card issuers, ISOs and other payment industry players such as software developers and technology outsourcers. He has provided strategic and legal advice to both Canadian and foreign clients in these fields and assists them regularly in implementing their business models. Mr. Faucher has played a leading role in card and merchant portfolio acquisitions, payment software licensing agreements, merchant agreements, processor-supplier/acquirer partnerships, network membership agreements, co-branded and private-label card program agreements, sponsorship agreements and BIN rental agreements. He has also provided advice on AML, codes of conduct and consumer protection legislation issues. Mr. Faucher works closely with clients in both the payment industry and the technology industry in developing innovative payment products. He has spoken on payments legal topics at client seminars and industry conferences.
