Canada’s Anti-Spam Law (CASL) is one of the toughest laws of its kind in the world, making its application and interpretation particularly challenging for US companies.

CASL, which governs the sending of commercial electronic messages and the installation of computer programs, has dramatically changed the legal landscape for US-based companies who engage in electronic marketing in Canada. CASL applies in respect of messages sent to and from Canada. CASL violations can lead to class action litigation, statutory damages and administrative penalties, extended liability for directors and officers, and significant damage to a company's reputation.
